Been refused?
A refusal isn’t always the end. Often the council’s reasons can be answered with a better application or a well-made appeal. Send us your decision notice and we’ll tell you which route gives you the best chance, with a fixed fee for each.
Check your deadline
Appeal deadlines run from the date on your decision notice, and they can’t be extended.
Shorter deadlines apply if an enforcement notice has been served. If you’re not sure which applies, send us the decision notice and we’ll confirm the date.
Your two options
Resubmit
Change the scheme to answer the reasons for refusal, then apply again.
- Often quicker than an appeal
- You can talk to the officer about the changes
- In many cases there’s no council fee for one resubmission within 12 months
Appeal
Ask the Planning Inspectorate to look at the decision again, independently of the council.
- Keeps the scheme as you want it
- Best when the council’s reasons are weak or inconsistent with its own policies
- Decided by an inspector, usually on written evidence
How our review works
- Send us the decision notice and, if you have them, the drawings that were submitted.
- We read the officer’s report, the council’s policies and recent decisions on similar schemes nearby.
- We recommend a route: resubmit, appeal, or in some cases not to proceed, with a fixed fee for each.
We can’t promise any outcome, but we’ll be straight with you about the chances.
